Zimmer Class Action
An Indiana based prosthetic device company by the name of Zimmer Inc. has announced the cessation of sales of its Durom hip replacement device. Specifically, the Durom “cup” which is the chromium alloy piece that replaces the hip joint’s natural socket (known as the acetabular) is being withdrawn from the market pending investigation of complaints from surgeons in the United States.
The suspension of sales is being limited to the U.S. The Durom cup and corresponding alloy heads (that replace the “ball” portion of the joint) will all remain off the market until, according to Zimmer, they have been able to institute a training program for orthopedic surgeons in this country so that they know how to properly use the product.
Zimmer also sites the lack of complaints in the European market, where the Durom cup has been in use since 2003. The New York Times, however, notes that the device being used in Europe has different design elements than the U.S. version. IN this country, the Durom cup was cleared by the FDA for sale in the U.S. in 2006. Two years and 12,000 American implants later, the product is being recalled by the manufacturer.
Several people who have had trouble with the Zimmer Durom artificial hip replacement have consulted with attorneys about potential product liability. It’s a viable question, especially since the product has been marketed as a good choice for younger people with orthopedic deterioration in the hip area. Zimmer’s Durom cup is designed to work with large “heads” which are the metal balls used to replace the natural ball at the end of the femur during a hip replacement.
If sufficient cases emerge where doctors have done “revision” surgery on Durom hip implants, there is a good possibility that several cases will be merged into a class action suit. Our attorneys are monitoring legal activity in several states regarding potential lawsuits over the Durom cup and its questionable design. If you think you’re a candidate for an individual or a class action suit against Zimmer, please be in touch with us.
