The Davol Patch lawsuit is in fact many lawsuits filed on behalf of individuals who have suffered medical difficulties as a result of what has come to be known as the Davol Patch. The product in question is marketed under the Kugel brand as the Kugel Mesh Patch or Kugel Hernia Patch, as well as Composix Kugel Patches.
The Davol Patch was brought to market as a device to be implanted surgically during the course of a hernia repair. It has a plastic ring that holds the mesh and acts as a frame for the patch, which can be folded and inserted behind the hernia. When in place, the Davol Patch springs back to its original size and shape. A pattern of patient complaints about abdominal problems following surgical installation of these patches led to a recall of certain production runs of the patch in December of 2005.
In early 2006 the first Davol Patch lawsuit was filed, claiming product liability and seeking damages for harm caused by the patch. The weak point in the patch design has proven to be the point at which the ends of the plastic ring or frame are welded together. The welds have failed in many instances, leading to exposed plastic pieces that are narrow and have sharp points.
The number of suits filed against Davol Inc. has grown so large that all federal cases involving the patch have been consolidated and transferred to the District of Rhode Island for pretrial proceedings.
